Unfortunately there is no simple answer to the question. The courts do consider an equal division of the family assets as a measure of whether any particular financial settlement is fair and reasonable, but it is often the case that an unequal division is in practical terms a fairer one, when taking into account the ages of the parties, their earning capacity and their childcare responsibilities amongst other things.
