I have an Enduring Power of Attorney, is it still valid?

Enduring Power of Attorney’s (EPAs) can no longer be created, however if an individual had one made prior to October 2007, registered or unregistered it can continue to be used.

An EPA is a document appointing an attorney to manage your property and financial affairs.These have since been replaced and updated with Lasting Power of Attorneys (LPAs) as these are for both property & financial, and health & welfare decisions, giving the donor further protection and extra options.

If you, or somebody you know, has already made an EPA and still has capacity, they can choose to simply keep their existing EPA and make an additional Health and Welfare LPA to assist their existing EPA, or replace it completely with a property and financial LPA.

The Attorney is the person responsible for registering the EPA, as the EPA is only registered when the Attorney believes that the Donor is becoming or has become mentally incapable of handling their own affairs.
