Why use a Solicitor to write your Will?
It is perfectly fine to go ahead and create a Will yourself, however it is advisable to have a Solicitor write up your Will for a number of reasons:
There are common mistakes that people make when creating a Will, the most prevalent being that if any alterations are made to a Will, but they are not signed and witnessed, the Will is then invalid. Other examples of common mistakes are failing to take account of all the money and property available, or not being aware of the formal requirements needed to make a Will legally binding.
If there are errors in your Will, this can cause numerous problems after your death. The sorting of misunderstandings and disputes after your death could have an array of negative outcomes, such as considerable legal costs, or in the worst case, if your Will is deemed void it is unusable and your estate will be bound to the Rules of Intestacy. This means that your wishes won’t be upheld and your estate will be equally divided between entitled heirs, which may not have been your wish.
It is for these reasons it is always advised to either have a Solicitor write your Will, or at least check it for you in the instance where you have made one yourself.
